Terms of Service
These Terms of Service are written for a Netherlands / EU operating model. They describe how the GoSwapCards platform actually works — including fees, shipping rules, SecureSwap, and the Authentication Service — and what you and GoSwapCards may expect from each other. Questions about these Terms are welcome via the contact details in Section 15.
Plain-language summary
The five points below paraphrase what the full Terms already say. They are not a substitute for it — if anything here ever seems to disagree with a numbered section, the numbered section is what applies.
- GoSwapCards runs the marketplace and, for SecureSwap and Authentication Service deals, temporarily holds items to inspect, package, and forward them — it isn't the seller of your listing.
- On a standard sale the buyer pays the item price, shipping, and one service fee of 3% + € 0,75 per order; the seller pays a seller fee of 3% of the item price, with a minimum of € 0,50 per order, which is deducted from the payout.
- Material changes to these Terms come with advance notice where feasible, and never rewrite a deal you already accepted.
- You must be 18+, keep your account details accurate, and are responsible for activity under your login.
- The Privacy Policy, Shipping Policy, and SecureSwap Policy are part of this agreement — see Section 5 for what that covers.
1. Agreement to Terms
These Terms of Service govern your access to and use of the GoSwapCards website, platform, services, tools, workflows, SecureSwap services, Authentication Service, and related applications or features.
By creating an account, listing an item, making or accepting an offer, buying, selling, trading, using SecureSwap, using Authentication Service, or otherwise using the platform, you agree to be bound by these Terms and the policies incorporated into them by reference.
If you do not agree to these Terms, you must not use the platform.
The platform is operated by GoSwapCards B.V., trading as GoSwapCards, and operated by Vincent Wiechers.
GoSwapCards® is a registered trademark of GoSwapCards B.V. The platform is focused on safer, more transparent trading card transactions.
These Terms apply to all users of the platform, including buyers, sellers, traders, collectors, visitors, account holders, and professional sellers.
We may update these Terms from time to time. If we make material changes, we will publish the updated version on the platform, update the updated date above, give registered users reasonable advance notice where feasible (for example by email or in-platform notification), and provide any notice required by applicable law.
If you do not accept a material change, you may stop using the platform and close your account before the change takes effect. Continued use of the platform after the effective date of the updated Terms means you accept the revised Terms. Material changes do not retroactively alter deals that were already accepted before the effective date, except where required by law or reasonably necessary to complete those deals safely.
2. Definitions
Buyer means a user who purchases or agrees to purchase an item through the platform.
Seller means a user who lists, sells, offers, or agrees to transfer an item through the platform.
Trader means a seller acting for purposes relating to that person's trade, business, craft, or profession under applicable consumer law.
Non-professional seller means a seller not acting as a Trader.
Trade means a card-for-card exchange, with or without an additional cash component.
Hybrid deal means a transaction involving one or more items plus a cash balancing payment.
Authentication Service means the optional Sale purchase flow for eligible items where the seller ships first to the designated GoSwapCards Authentication Hub intake address and GoSwapCards performs an authenticity check based on available visual and scan-based indicators before any forwarding step.
SecureSwap means the hub-mediated intake, holding, inspection, authentication-support, evidence, packaging, and outbound-release workflow described in these Terms and related policies for eligible trade and hybrid flows.
Hub means the GoSwapCards-operated handling workflow for eligible SecureSwap and Authentication Service transactions. A designated package intake address or handling point may be used for receipt, while inspection, authentication support, storage, packaging, and dispatch may occur through the applicable GoSwapCards operational process. The public intake address is not represented as the location of every internal handling step.
Order means a completed or accepted purchase, trade, or hybrid deal on the platform.
Origin address means the shipping address associated with the sender at the point of shipment into a transaction or SecureSwap flow, as recorded by GoSwapCards.
Return-to-Origin means a process in which an item is returned to its recorded origin address or another address designated by GoSwapCards where reasonably necessary.
Policies means the Privacy Policy, Shipping Policy, SecureSwap Policy, and any other policy expressly incorporated into these Terms.
3. About GoSwapCards and platform role
GoSwapCards is a marketplace and transaction facilitation platform focused on trading cards and related collectibles.
Depending on the transaction type, GoSwapCards may act as a marketplace intermediary, transaction facilitation provider, shipping workflow coordinator, payment and payout workflow coordinator, authentication or inspection service provider, and SecureSwap hub-handling service provider.
Except where expressly stated otherwise, GoSwapCards is not the seller of user-listed items and does not take title to items in standard marketplace transactions. Sellers remain responsible for the legality, authenticity, description, and transferability of listed items.
In SecureSwap transactions and Authentication Service transactions, GoSwapCards may take temporary physical possession of items solely for operational purposes such as intake, inspection, authentication support, evidence capture, packaging, holding, routing, forwarding, and outbound dispatch. That operational role does not make GoSwapCards the commercial seller of the items unless explicitly stated otherwise.
The address displayed in an order or shipping flow is the designated GoSwapCards intake address for that shipment. GoSwapCards manages the applicable intake, review, and forwarding process. Internal handling and security details are not published.
GoSwapCards may impose mandatory operational rules for listings, payments, shipping, tracking, identity checks, trader verification, authentication, address confirmation, cancellation, dispute handling, and Return-to-Origin where reasonably necessary to protect users, comply with law, or preserve marketplace integrity.
4. Eligibility and account registration
You must be at least 18 years old to create an account and use the transactional features of the platform, unless applicable law permits narrower use by minors with valid parent or guardian consent and GoSwapCards expressly allows it.
You must provide complete, accurate, and current information when creating and maintaining your account and when using the platform.
You may not impersonate another person or entity, create an account using false or misleading information, register on behalf of another person without authority, or conceal relevant identity or trader-status information.
You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account.
You are responsible for complying with all laws and regulations applicable to you, including tax, customs, sanctions, shipping, consumer, fraud-prevention, and product-compliance rules.
6. Marketplace transparency and seller status
The platform may show whether a seller is a Trader or professional seller, or a non-professional seller.
Where required by law, this information may be shown on the listing page, during offer or checkout flow, and in the order or transaction confirmation.
If the seller is a Trader, mandatory consumer protection rules may apply to the contract between the seller and the consumer, including statutory rights relating to information duties, conformity, and, where applicable, withdrawal rights.
If the seller is not a Trader, some consumer protection rights that apply to contracts with professional sellers may not apply.
Sellers must classify themselves truthfully. GoSwapCards may request supporting information and may reclassify, suspend, or restrict accounts where seller-status information appears inaccurate, incomplete, or misleading.
7. Listings, product information, and pricing
Sellers and traders are solely responsible for the content and accuracy of their listings, including title, images, set and print information, rarity and language, authenticity, condition, defects, restorations, quantity, included accessories, price, and shipping terms.
You must describe item condition honestly and consistently with any condition guidance published by GoSwapCards.
Prices may be fixed by the seller, negotiated between users, established through offer flows, established through auction or bid/ask mechanics, or adjusted in a hybrid deal that includes cash and cards.
A price shown on a listing, in search results, or on a card page is the item price. Shipping is not included in it, because shipping depends on the delivery method and delivery address chosen later; the buyer service fee that applies to a purchase is stated next to the price and again in checkout.
The total shown in checkout before you confirm is the amount that is charged. GoSwapCards does not add a further fee, surcharge, or tax amount to that total afterwards. Where a transaction type involves a later, separate payment — for example a SecureSwap forwarding shipment — that payment is presented, priced, and confirmed separately at the time it becomes due.
For SALE purchases, the buyer pays the listing price, the selected shipping method, and one service fee shown in checkout: 3% of the item price plus € 0,75 per order. On an order with the Authentication Service, the service fee is 3% of the item price only, without the fixed part.
For SALE purchases, the seller pays a GoSwapCards seller fee of 3% of the item price, with a minimum of € 0,50 per order (deal). The seller fee is deducted from the seller payout. It is not charged over shipping: the postage reimbursement for a letter is paid out in full.
GoSwapCards does not guarantee that listings, valuation estimates, market data, item descriptions, or price references are complete, current, or error-free.
8. Transaction types
The platform may support fixed-price sales, negotiated sales, auctions, bid or ask style transactions, direct card-for-card trades, hybrid deals involving cards plus cash, Authentication Service transactions, SecureSwap transactions, and other transaction models introduced by the platform.
Each transaction type may have distinct rules regarding shipping, payment timing, inspection, authentication, cancellation, refund handling, and dispute outcomes.
In direct transactions where SecureSwap or Authentication Service is not required or selected, users ship directly to the counterparty unless GoSwapCards instructs otherwise.
Where SecureSwap is selected or required, all parties must comply with the SecureSwap rules and related policies.
Where Authentication Service is selected for an eligible Sale purchase, the seller ships to the designated GoSwapCards Authentication Hub intake address first and does not ship directly to the buyer.
When you submit, accept, confirm, or otherwise finalize a transaction through a flow designated by the platform as binding, you enter into a binding transaction subject to these Terms and applicable law.
9. Fees, charges, payments, payouts, offsets, and holds
GoSwapCards may charge fees for use of the platform, including the SALE service fee, trade service fees, SecureSwap fees, Authentication Service fees, shipping label or shipping-service fees, hub forwarding fees, the high-value fee, the cash fee on hybrid deals, dispute or return processing fees, premium feature fees, subscription fees, and any other fee that is clearly stated for a specific flow.
For SALE purchases, the buyer pays the item or listing price, the selected shipping method, and one service fee of 3% of the item price plus € 0,75 per order (deal), charged once per order however many cards it contains. The seller pays a GoSwapCards seller fee of 3% of the item price, with a minimum of € 0,50 per order (deal), deducted from the seller payout.
Within the Netherlands the shipping method is priced as shown in checkout: for orders under € 100, a letterbox parcel with tracking costs € 5,45 and any other parcel costs the real carrier price with a floor of € 10,45; from € 100 every parcel costs the real carrier price. Any route that is not within the Netherlands is charged the real label price plus € 2,99. For a letter the buyer pays € 3,75 within the Netherlands, of which € 2,95 is paid out to the seller for the postage, and € 4,75 on any other route, of which € 4,25 is paid out to the seller.
Authentication Service is optional for eligible Sale purchases from € 50 item or bundle value. If selected, the buyer pays the € 7,99 authentication fee (which includes up to 5 cards; each further card adds € 2, with no maximum cap), seller-to-hub shipping, and hub-to-buyer forwarding where applicable and shown in checkout or the order flow. On such an order the service fee is 3% of the item price, without the fixed part.
Paying with iDEAL, Bancontact or a card costs nothing extra. Every payer is offered the available payment methods at no extra cost.
A typical two-party SecureSwap may involve four physical shipping legs: Party A sends its cards to GoSwapCards, Party B sends its cards to GoSwapCards, Party A's approved cards are forwarded to Party B, and Party B's approved cards are forwarded to Party A. Together with intake, temporary holding, review, packaging, and forwarding, these logistics can cost more than direct shipping. The checkout or order flow remains the source of truth for the amount payable in a specific transaction.
Trade service fee. Each party to a direct trade pays € 2,99. Each party to a SecureSwap trade pays € 7,99, or € 3,99 when the known value of that party's own sent cards is under € 50 and the deal contains no cash; a party whose card value is not known pays € 7,99. At € 7,99 up to 5 of a party's own cards are included. At € 3,99 one card is included and each further card up to 5 adds € 1. On both, each card above 5 adds € 2.
Hub forwarding and high-value fee. Where GoSwapCards forwards cards from the hub (SecureSwap and Authentication Service), the forwarding shipment is priced as shown in checkout. From a forwarded value of € 250, a high-value fee of 1,5% of that value applies, with a minimum of € 4,95 and no cap. It is a logistics and handling fee, not insurance (see Section 10), and it never applies to a direct SALE shipment.
Cash fee on hybrid deals. Where a deal includes a cash balancing payment, the party who pays the cash pays a cash fee of 3% of the cash amount on top of it, and the party who receives the cash is paid the cash amount minus a cash fee of 3%. There is no free amount and no minimum. On a deal that was created before these fees took effect, the receiving party is paid the full cash amount.
Current fees, if any, will be stated on the platform, in a fee schedule, on the checkout page, in the order summary, or in another clearly identified pricing area.
Payments may be processed by third-party payment providers, including Stripe or other providers selected by GoSwapCards.
Seller or participant payouts may be delayed, split, held, reversed, or cancelled where reasonably necessary for payment authorization, fraud screening, authenticity review, SecureSwap completion, shipping confirmation, investigation of complaints, chargeback handling, legal or regulatory compliance, or policy enforcement.
Automatic timing rules for Sale purchases. Some steps continue on a timer when a party does not act, so a transaction cannot stay open indefinitely. (a) Once arrival is confirmed, the buyer has a 48-hour inspection window to report a problem; if no problem is reported within that window, the purchase is treated as accepted and the seller payout is released. (b) If no arrival confirmation ever follows — including for manual untracked letter shipping, where no carrier delivery scan exists — the purchase can be settled 30 days after dispatch, provided there is no open problem report, dispute, or refund request. (c) If the buyer's payment has been captured for the seller but the seller has not shipped within 7 days, the purchase can be cancelled and the buyer's payment released back.
These timers are operational defaults, not a waiver of your rights. Reporting a problem, an open dispute, a chargeback, or a refund request pauses the relevant timer, and statutory rights — including the consumer right of withdrawal where it applies and claims about items that do not match their description — remain available after a payout has been released. GoSwapCards may reverse, offset, or recover an already-released amount to give effect to such an outcome.
To the extent permitted by law, GoSwapCards may offset amounts otherwise payable against amounts owed to GoSwapCards or amounts reasonably required for refunds, chargebacks, shipping remediation, Return-to-Origin costs, authentication or investigation costs, unpaid fees, or compensation due under a completed dispute outcome.
For accepted bilateral SecureSwap swap and hybrid deals using verification_option = secureswap, each party may be required to complete a separate accepted-checkout payment step. In those bilateral SecureSwap flows, each party's payment obligation is assessed separately and both required payments must be completed before the transaction can move into first-leg shipping.
10. Shipping, delivery, tracking, Authentication Service, and SecureSwap handling
Users must comply with all shipping rules applicable to their transaction type and value tier. Unless GoSwapCards specifies otherwise, shipments must be properly packaged, accurately addressed, shipped within the required deadline, sent using an allowed carrier and method, and accompanied by valid tracking where required.
Specific shipping eligibility is determined in the checkout flow. As a general policy, a letter without tracking is a buying option only: one loose card under € 30, within the Netherlands or abroad, at the sender's risk. From € 30 every SALE purchase ships with tracking. Trade (swap) shipments always ship with tracking; a letter is not offered for trades.
For SALE purchases within the Netherlands and for orders under € 100, up to 5 loose cards or one graded card (slab) under € 75 may ship as a tracked letterbox parcel; anything else ships as a tracked parcel. From € 250 the full physical shipment value (base listing plus any seller-side bundle items) requires a tracked parcel with verified signature on delivery. Insurance or declared value alone does not satisfy the signature requirement. Where no shipping method with verified signature on delivery is available for the route, checkout for that order is blocked rather than falling back to a lower shipping level.
GoSwapCards may require tracked or registered shipping where route, account, value, packaging, carrier, or fraud-risk factors make a stronger method necessary.
Untracked letter shipping is cheaper but has no tracking. It is used at the sender's risk. GoSwapCards cannot verify or compensate a lost untracked shipment before delivery or, for SecureSwap or Authentication Service, before receipt at the designated GoSwapCards intake address.
Tracked or registered shipping provides better evidence, but it does not create unlimited GoSwapCards liability or guarantee compensation. GoSwapCards may use tracking, delivery scans, hub receipt records, evidence voluntarily provided through support, hub photos, scans, outbound-packaging records, support records, and dispute evidence to decide operational, support, refund, release, or settlement outcomes.
Depending on transaction type, value, destination, or risk score, GoSwapCards may require tracked shipping, registered shipping, signature confirmation, parcel-only shipping, mandatory carrier classes, minimum packaging standards, insurance, shipment to or from a specified address, or use of a label purchased or generated through the platform.
Where a shipment value is not already fixed by a purchase price — in particular for trades and for cards sent to the GoSwapCards hub — that value is derived from the information the user provides, such as listing prices, agreed trade amounts, or a stated card value. Users are responsible for stating those values accurately and in good faith.
The stated value determines which shipping level, packaging standard, handling class, high-value transport fee, and shipment protection premium apply. A value stated too low can therefore result in a lighter shipping method, less handling protection, and a lower basis for any operational compensation GoSwapCards may offer in a support or dispute outcome. GoSwapCards may correct or re-classify a shipment when the stated value is clearly inconsistent with the items, and may refuse or pause handling in that case.
The high-value transport fee is a logistics and handling fee only. It is not insurance, not shipment coverage, not a loss guarantee, and not a protected-shipment promise, and it must not be relied on as such. Any rights that cannot lawfully be excluded, including mandatory consumer protections and liability for damage caused by GoSwapCards itself, remain unaffected.
While cards are physically held by GoSwapCards for SecureSwap or Authentication Service — from receipt at the designated intake address until outbound dispatch — GoSwapCards handles them with reasonable care and documents their condition through intake and outbound records. If an item is lost or damaged during that period through GoSwapCards' own handling, GoSwapCards remains responsible under applicable law; this is separate from a shipment lost in carrier transport, which is assessed under the shipping rules in this section. Any operational compensation is assessed on the documented value of the item, taking account of the value the user stated for the shipment, the available intake and outbound evidence, and mandatory law. GoSwapCards does not act as the seller of user-listed items in a trade, but that does not limit its responsibility for its own handling.
Users are responsible for ensuring that all addresses they provide are complete, accurate, deliverable, and lawful to use.
GoSwapCards may lock, verify, or snapshot sender and recipient address data at one or more stages of a transaction for fraud prevention, shipping integrity, dispute handling, SecureSwap routing, Authentication Service routing, auditability, and legal compliance.
Before shipping cards, we strongly recommend creating clear evidence of their condition and packaging.
Take clear photographs of the front and back of the cards and of the sealed, shipment-ready package. We also recommend recording one continuous, unedited video showing the condition of the cards, the protective materials used, the cards being packaged, and the final shipping package being sealed.
Keep the original photo and video files until the transaction and any related support or dispute review have fully ended. You do not need to upload this evidence to GoSwapCards during the normal shipping process. If a shipping problem, damage report, condition dispute, or authenticity concern is reported, GoSwapCards may ask you to provide the original files.
Clear and complete evidence may help GoSwapCards understand what happened before shipment. Missing, incomplete, unclear, or edited evidence may make a report more difficult to assess and may be considered together with tracking information, carrier information, photographs, hub records, messages, and all other available information.
The absence of a video does not automatically determine liability or result in the rejection of a report. Photos, videos, and tracking information do not always prove where damage occurred or who is responsible. Any rights that cannot legally be excluded remain unaffected.
For Authentication Service, the seller ships to the designated GoSwapCards Authentication Hub intake address first. GoSwapCards performs an authenticity check based on available visual and scan-based indicators. This is not a formal grading certificate.
For Authentication Service, GoSwapCards may capture package and card photos, visible transport damage, relevant detail images, scan records, tracking and intake events, outbound-packaging records, and support notes. If authentication raises concerns, GoSwapCards may pause forwarding for admin review and may request additional review before deciding the next operational step.
For Authentication Service, dispatch from the hub to the buyer is not the same as buyer receipt confirmation and does not by itself complete the order or transfer ownership. Buyer receipt or arrival confirmation remains the customer-facing completion point according to the applicable Sale flow.
A rejected or suspected fake Authentication Service outcome is an admin review state. It is not an automatic refund promise in this Terms copy, and any refund, hold, return, or escalation outcome depends on the applicable flow, evidence, payment state, mandatory law, and platform review.
SecureSwap is the GoSwapCards hub-mediated transaction flow used for intake, holding, inspection, authentication support, matching verification, evidence, packaging control, outbound routing, and risk control. In SecureSwap, users typically do not ship directly to each other. Instead, items are shipped to the designated intake address and are only released when required conditions are met.
A two-party SecureSwap typically contains four physical shipping legs: Party A sends its cards to GoSwapCards, Party B sends its cards to GoSwapCards, Party A's approved cards are forwarded to Party B, and Party B's approved cards are forwarded to Party A.
SecureSwap first legs always ship with tracking. Hub verification starts only once the shipment is received at the designated GoSwapCards intake address. If a trade is cancelled before dispatch, a platform label that was bought but not used is cancelled with the carrier.
Unless GoSwapCards expressly states otherwise, no outbound release will occur unless all required conditions are satisfied, including both inbound packages being received, both sides passing required checks, all necessary address confirmations being complete, and all payment, fraud, and compliance checks being complete.
If an item is wrong, incomplete, unsafe, suspicious, or does not pass the required review, GoSwapCards may pause the case and use the applicable Return-to-Origin, refund, hold, or recovery process rather than forwarding the items as a completed trade.
For accepted bilateral SecureSwap trades and hybrid deals using verification_option = secureswap, both parties must complete the required accepted-checkout payment step within the applicable payment window before first-leg labels can be created or released.
For those bilateral SecureSwap swap and hybrid flows, the accepted-checkout payment window is 72 hours from the moment the required payment step is made available to both parties, unless GoSwapCards expressly states otherwise in a transaction-specific flow.
If both required bilateral SecureSwap payments are not completed within the payment window, the transaction does not proceed as a normal user-cancel flow. Instead, it moves into the SecureSwap policy, expiry, default, or recovery path handled by GoSwapCards under these Terms and the applicable policies.
Evidence can help compare condition across stages and assess whether an issue is more consistent with insufficient packaging, carrier handling before intake, GoSwapCards handling, or outbound transport. It does not guarantee that every cause or responsible party can always be established with certainty and does not create blanket insurance, automatic compensation, or unlimited liability.
Once GoSwapCards has completed hub verification and approved a SecureSwap trade for outbound release, personal preference, changed opinion, or subjective dissatisfaction alone does not create a return right. Claims involving damage, mismatch, non-conformity, or other legally relevant issues are assessed under the applicable evidence, flow, policies, and mandatory law.
11. Cancellations, returns, withdrawal rights, and Return-to-Origin
GoSwapCards may pause, cancel, reverse, or terminate a transaction where reasonably necessary to prevent fraud, comply with law, protect users, enforce these Terms, address authenticity concerns, address shipment or tracking failures, or resolve a material transaction mismatch.
For standard sales or direct transactions, refunds or returns may depend on applicable mandatory law, the seller's lawful return terms where permitted, the seller's status as Trader or non-professional seller, the transaction type, evidence submitted, and the timing of the complaint.
After a deal has been accepted, a user cancellation request is not an automatic right to cancel the deal. It is a request for the other party's consent to mutually cancel the accepted deal, unless GoSwapCards determines that platform policy, operational safety, or mandatory law requires a different outcome.
The other party may accept or decline an accepted-deal cancellation request at that party's discretion. If the request is accepted, the deal may be cancelled and any eligible payment authorization or payment may be released or refunded according to the applicable payment state, these Terms, processor constraints, and mandatory law.
If an accepted-deal cancellation request is declined, the deal continues as agreed. The requesting party remains responsible for completing all required steps, including payment, shipment, delivery, receipt confirmation, cooperation with support, and any other order-flow obligation that applies to that transaction type.
Where the seller is a Trader and the buyer is a consumer, statutory withdrawal rights may apply under mandatory consumer law unless a lawful exception applies.
In transactions between private parties, statutory consumer withdrawal rights that apply to contracts with Traders may not apply.
For GoSwapCards' own paid services that a consumer purchases at a distance, such as the buyer service fee and the optional Authentication Service, the statutory 14-day right of withdrawal applies in principle under Dutch law. By accepting these services in checkout, you expressly request that GoSwapCards performs them immediately, and you acknowledge that you lose the right of withdrawal for those services once they have been fully performed. If you withdraw before full performance, you owe a proportionate amount for the part of the service already performed, in line with Articles 6:230o and 6:230p of the Dutch Civil Code.
If SecureSwap is cancelled or cannot be completed, GoSwapCards may return each party's items to that party's recorded origin address or another address reasonably designated by GoSwapCards for security, compliance, or delivery reasons.
If Authentication Service cannot proceed because authenticity concerns, missing evidence, wrong contents, shipment problems, or compliance issues require admin review, GoSwapCards may pause forwarding and determine an operational review outcome before further routing.
For accepted bilateral SecureSwap swap and hybrid deals using verification_option = secureswap, there is no free user-cancel once both parties have completed the required accepted-checkout payment step. After both required payments are complete, cancellation, expiry, default handling, item release, Return-to-Origin, refund handling, and any operational settlement outcome are handled through the SecureSwap policy/admin path and not through an ordinary unilateral user cancellation flow.
If one party completes the required bilateral SecureSwap payment step and the other party does not complete it within the 72-hour payment window, the transaction may be stopped before first-leg label release. The paying party may receive a refund or payment release for refundable amounts, subject to non-recoverable processor costs, already-incurred operational costs, and mandatory law.
If both parties have completed the required bilateral SecureSwap payment step and first-leg labels have been unlocked, but one party fails to ship within the required deadline, GoSwapCards may cancel the trade, return any received items to origin, deny refund eligibility to the defaulting non-shipping party to the extent permitted by law, and determine an appropriate refund, hold, offset, or settlement outcome for the compliant party after taking account of irreversible operational or carrier costs.
Nothing in these Terms should be read as a blanket insurance promise, unconditional refund guarantee, automatic payout guarantee, or guaranteed compensation for untracked loss, carrier failure, damage, delay, customs issue, missing scan, or user non-compliance. Where a shipment protection premium is charged at checkout, third-party insurance cover is purchased for that specific shipment up to the declared amount, subject to the insurer's own policy terms, sub-limits, exclusions, and claim deadlines; that purchased cover is the sole exception to this paragraph and creates no obligation for GoSwapCards beyond passing on a received payout.
12. Seller obligations, buyer obligations, and prohibited conduct
Users offering items for sale or trade must have the legal right to transfer the item, describe the item truthfully and accurately, disclose material defects or authenticity concerns, classify seller status truthfully, comply with applicable consumer, tax, customs, and shipping rules, ship on time according to platform requirements, provide valid tracking where required, cooperate with reasonable requests for available packaging or shipment evidence, and cooperate with investigations, authentication checks, disputes, or compliance reviews.
Buyers and trade counterparties must provide accurate account and shipping information, pay all required amounts when due, respond promptly to required confirmations, comply with Authentication Service or SecureSwap procedures where applicable, inspect and report issues promptly and truthfully, preserve relevant evidence, and refrain from abusive, fraudulent, or manipulative complaints or chargebacks.
You may not list, offer, sell, ship, or trade counterfeit or prohibited items, commit fraud or deception, manipulate prices or offers, create fake accounts, evade fees or platform controls, provide false tracking, false evidence, or false delivery claims, misuse payment systems or chargebacks, interfere with platform security or operations, harass or abuse other users or staff, violate intellectual-property rights, or attempt to bypass mandatory SecureSwap, shipping, or verification controls.
Account records and trading restrictions: where a user does not meet these obligations — for example by repeatedly failing to ship, sending items that do not match the agreed description, or misusing disputes or chargebacks — GoSwapCards may record that outcome on the account. Depending on severity and repetition, GoSwapCards may issue a warning, require stronger shipping or verification steps, temporarily restrict access to trading, or, in serious or repeated cases, permanently restrict trading access. Restrictions are applied proportionately and do not remove amounts already owed to a user.
If your account is restricted, you are told the main reason and can ask for a review by contacting support at the address in Section 15. A trading restriction also blocks the transaction steps you would normally take yourself, such as marking a shipment as sent, confirming receipt, choosing a shipping method or address, or releasing a payout. Transactions that were already running are therefore paused and completed by GoSwapCards under these Terms and the applicable policies, including refunds, payouts, or returns to the other party where that is the appropriate outcome. You keep access to your account data and to amounts already owed to you, except where mandatory law, payment-provider rules, or an active investigation require otherwise.
Reporting illegal content (EU Digital Services Act): anyone, including people without an account, can report listings, images, or other content they consider illegal or in breach of these Terms through the in-platform report and support flows or by email to the legal notices address in Section 15. A useful notice explains why the content is considered illegal, where it is located (for example a listing link), and how we can contact you. We review such notices without undue delay, take the action we consider appropriate (such as removal, restriction, or suspension), and inform the notifier and, where applicable, the affected user of the decision and the main reasons for it.
13. Trademark and brand use
GoSwapCards® is a registered trademark of GoSwapCards B.V. The platform is focused on safer, more transparent trading card transactions.
You may not use the GoSwapCards name, GoSwapCards® mark, logo, branding, trade dress, or confusingly similar wording in a way that suggests sponsorship, endorsement, partnership, official status, or affiliation with GoSwapCards unless GoSwapCards has given prior written permission.
Nothing in these Terms transfers any intellectual-property rights in the GoSwapCards name, GoSwapCards® mark, platform branding, software, content, workflows, designs, documentation, or related materials to any user.
14. Risks, disclaimers, limitation of liability, governing law, and disputes
GoSwapCards is a platform and service provider. Except where explicitly stated otherwise, it is not the seller of user-listed items and does not guarantee the conduct of users.
GoSwapCards does not guarantee that all users act lawfully, honestly, or accurately, or that all listed items are authentic, error-free, or compliant.
GoSwapCards performs an authenticity check based on available visual and scan-based indicators when Authentication Service is used. This is not a formal grading certificate, not a professional grading service, and not an absolute guarantee of authenticity, condition, market value, or future acceptance by third parties.
GoSwapCards does not guarantee that a carrier will deliver a shipment, that an untracked shipment can be verified, or that tracking, scans, hub receipt, photographs, any video submitted through support, support records, or dispute evidence will always prove every event, cause, or responsible party in a shipment lifecycle.
Evidence may support an assessment of packaging failure, carrier handling, GoSwapCards handling, or outbound transport, but any conclusion depends on the total available record and the applicable transaction flow. Evidence does not itself create blanket insurance, automatic compensation, or unlimited liability.
The platform is provided on an as-is and as-available basis to the maximum extent permitted by law. GoSwapCards does not guarantee uninterrupted availability, perfect security, or error-free operation.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law, including mandatory consumer protections.
These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of the Netherlands, excluding conflict-of-law rules, except to the extent mandatory law in a user's country of residence provides otherwise.
If you are a consumer residing in the EU, nothing in these Terms deprives you of the protection of mandatory provisions of the law of your country of residence that apply to you.

16. Final clauses
These Terms and the incorporated policies form the agreement between you and GoSwapCards regarding the platform, except where separate written agreements apply.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.
A failure to enforce any provision is not a waiver of the right to enforce it later.
You may not assign your rights or obligations under these Terms without prior written consent. GoSwapCards may assign these Terms in connection with a merger, acquisition, restructuring, or sale of assets.
We review these Terms periodically and update them when the platform, our services, or applicable law changes. The version and date shown at the top of this page identify the version that applies.
